ICMS: Brazil's state VAT on goods, transport and communications

Last verified: 2026-10-25

ICMS is a state level VAT on goods, interstate and intermunicipal transport and communications, set by each of the 27 states within national rules. Interstate rates are fixed by the Senate at 12% or 7% depending on route, and 4% for imported goods; internal rates differ by state, for example 18% as the general rate in São Paulo. Under the tax reform ICMS is cut to 90% of its rates in 2029 and abolished in 2033.

The rule

1. Interstate ICMS on imported goods that were not industrialized after clearance, or that have import content above 40%, is 4%.Senate Resolution 13/2012, art. 1 and para. 1, 2012-04-25 official text
2. São Paulo applies 18% to internal operations as its general rate, 7% to interstate sales to taxpayers in the North, Northeast, Center West and Espírito Santo, and 12% to sales to taxpayers in the South and Southeast, citing Senate Resolutions 22/1989 and 13/2012.São Paulo ICMS Regulation (RICMS/SP, Decree 45,490/2000), art. 52, items I, II and III, 2013-02-27 official text
3. From 2029 to 2032 ICMS rates are set at 9/10, 8/10, 7/10 and 6/10 of the rates in state law, with tax benefits reduced in the same proportion.Constitutional Amendment 132/2023, art. 128 ADCT, 2023-12-20 official text
4. ICMS is extinguished from 2033.Constitutional Amendment 132/2023, art. 129 ADCT, 2023-12-20 official text

Worked example

A São Paulo manufacturer sells goods worth BRL 100,000 (about USD 19,850). To a taxpayer in Bahia: interstate ICMS at 7%, BRL 7,000. To a taxpayer in Paraná: 12%, BRL 12,000. If the same goods were imported and resold without industrialization: 4%, BRL 4,000. Inside São Paulo at the general rate: 18%, BRL 18,000. USD at the BCB PTAX selling rate of 23 October 2026, BRL 5.0377 per USD.

Step by step

  1. Register with the state tax authority (inscrição estadual) in each state where you hold an establishment.
  2. Classify products under the NCM and check the state rate, tax substitution (ICMS ST) and any state incentive.
  3. Model the location of warehouses and plants using interstate rates and incentives; incentives shrink from 2029.
  4. Prepare for the transition to IBS, where tax follows the destination.

Common traps

  • Using one state's internal rate as a national rate: internal rates vary by state and by product.
  • Applying 4% to imported goods that were transformed enough to bring import content to 40% or less.
  • Building long term plans on state incentives that are phased out between 2029 and 2032.
