The SII can generally assess within three years of the payment deadline, or six years where no return was filed or it was maliciously false, and once it has all requested documents it has nine months to act, twelve for transfer pricing and large taxpayers and eighteen for anti avoidance and indirect transfer cases. Audits typically run from a document request to a citación (one month to answer), then an assessment, which can be challenged by administrative reconsideration within 30 days or before the Tax and Customs Courts within 90 days, without paying first. Late tax is adjusted for inflation and bears interest set each semester from a market rate plus 3.5 points, with fines of 10 to 30 percent, and planners of abusive schemes face fines of up to 250 UTA.

USD figures use the Central Bank exchange rate of CLP 986.58 per US dollar published in the Diario Oficial of 23 October 2026 (Ley Nº 18.840 art. 44). Tax units use the SII values of UTM CLP 72,151 and UTA CLP 865,812 for October 2026 and UF CLP 41,221.08 for 26 October 2026. Conversions are for orientation only.

The rule

1. The SII can assess and review any deficiency and issue tax bills within three years from the end of the legal payment period, or six years for taxes subject to a return when no return was filed or it was maliciously false. A formal summons extends the period by three months for the items it covers. The Treasury's right to collect lapses in the same periods, interrupted by written acknowledgment, notification of an assessment or bill, or judicial demand.
Cost to do it: Keep records at least six years.Decreto Ley Nº 830, Código Tributario, Art. 200 and art. 201, 1974-12-31 official text · verified 2026-10-26
2. Once an audit starts with a request for documents, the SII has nine months from certifying that all requested documents were delivered (certification is due within ten days, or deemed given) to summon, assess, rule or bill, or certify there are no differences. The term is twelve months for transfer pricing, taxpayers with sales above 5,000 UTM in the prior year, reorganizations and related party accounting, and eighteen months for the anti avoidance rules, art. 10, 41 F, 41 G and 41 H, certain inheritance tax reviews, intelligence based reviews and requests to foreign authorities. Each term can be extended once by six months. The SII generally cannot re audit the same items and period.
Cost to do it: Defence cost only. The 5,000 UTM sales threshold is CLP 360,755,000 at the October 2026 UTM.
Example: 5,000 UTM of sales is CLP 360,755,000. / About US$365,662.19.Decreto Ley Nº 830, as amended by Ley Nº 21.713, Art. 59, 2024-10-24 official text · verified 2026-10-26
3. The SII may issue a citación asking the taxpayer to file, correct, clarify, expand or confirm a return within one month, extendable once by up to one month on request, and may ask for clarifications within a further month without a new citación. The citación is a mandatory prior step where the law requires it, as in transfer pricing challenges under DL Nº 824 art. 41 E.

4. Any person can challenge an assessment, tax bill, payment or resolution affecting the determination of a tax before the Tax and Customs Court of the territory of the SII unit that issued it, within a final term of 90 days from notification, extended to one year if the assessed amount is paid within 90 days. Administrative reconsideration (reposición) can be filed within 30 days and suspends the court term; it is deemed rejected if not decided within 90 days. Prior payment is not required to file a claim, and the court can suspend collection. Judgments can be appealed, with cassation in form, within 15 days to the Court of Appeals.
Cost to do it: Legal representation costs; no prior payment of the assessed tax is required (art. 147).Decreto Ley Nº 830; Ley Nº 20.322, Art. 115, art. 123 bis, art. 124, art. 140 and art. 147, 2009-01-27 official text · verified 2026-10-26
5. Late filing of returns that are the basis for a tax is fined 10 percent of the tax if no more than five months late, plus 2 percent per additional month, up to 30 percent. Late payment of withheld or surcharged taxes, such as withholding on payments abroad and VAT, is fined 10 percent plus 2 percent per month, up to 30 percent, and 20 to 60 percent when the SII detects the omission in an audit. Incomplete or wrong returns that could reduce tax are fined 5 to 20 percent of the difference unless due diligence is proven; maliciously false returns are tax offences.
Cost to do it: On CLP 98,658,000 of withholding paid three months late: fine of CLP 15,785,280 (16 percent), plus inflation adjustment and interest.
Example: Fine of CLP 15,785,280 on CLP 98,658,000. / US$16,000 on US$100,000 of withholding.Decreto Ley Nº 830, Art. 97 Nº 2, Nº 3, Nº 4 and Nº 11, 1981-02-12 official text · verified 2026-10-26
6. Unpaid taxes are adjusted by consumer price inflation and bear daily penalty interest. The rate is the current interest rate published by the Financial Market Commission for readjustable operations of one year or more up to 2,000 UF, increased by 3.5 points; the SII fixes the rate each semester by resolution published in June and December, divided by 360 and applied per day of delay. Taxes paid within 90 days of an assessment bear interest only up to the assessment date.
Cost to do it: Interest at a market rate plus 3.5 points a year, plus inflation adjustment.Decreto Ley Nº 830, as amended by Ley Nº 21.713, Art. 53 and art. 54, 2024-10-24 official text · verified 2026-10-26 · changed: Ley Nº 21.713 (Diario Oficial 24 October 2024) replaced the fixed monthly interest rate with a semester rate based on the Financial Market Commission benchmark plus 3.5 points.
7. Tax obligations follow the legal nature of the acts carried out, and the SII must recognise taxpayers' good faith. Avoidance through abuse or simulation is reviewed under the general anti avoidance rule, with special anti avoidance rules taking precedence for single acts; the power to review lapses six years after the payment deadline. Taxpayers can ask the SII for a binding opinion on whether the general or a special rule applies to a planned transaction. Anyone found to have designed or planned the abusive or simulated acts is fined 100 UTA, or 250 UTA if repeated, or up to the fees agreed with a 250 UTA cap.
Cost to do it: Planner fine of 100 to 250 UTA, CLP 86,581,200 to CLP 216,453,000 at the October 2026 UTA.
Example: CLP 86,581,200 to CLP 216,453,000. / About US$87,758.92 to US$219,397.31.Decreto Ley Nº 830, as amended by Ley Nº 21.713, Art. 4 bis to 4 quinquies, art. 26 bis and art. 100 bis, 2024-10-24 official text · verified 2026-10-26
8. The SII may request and cross check named data from all state bodies for audit purposes. Courts of Appeals take over matters of the abolished special appeal tribunals. For 180 days from publication of Ley Nº 21.850, the Treasury may grant payment facilities for taxes due up to 31 December 2025, condoning up to 100 percent of interest and 80 percent of fines for cash payment, or up to 95 percent of interest and 75 percent of fines under an instalment plan with at least 10 percent down.
Cost to do it: Amnesty can remove most interest and fines on old debts if paid in the window.Ley Nº 21.850, Art. 18 (Código Tributario art. 59 and art. 120) and second transitory article, 2026-10-17 official text · verified 2026-10-26 · changed: Ley Nº 21.850 (Diario Oficial 17 October 2026) expanded SII data access and opened a 180 day Treasury condonation window for taxes due up to 31 December 2025.

Worked example

  • In 2027 the SII asks a Chilean SpA for documents on 2024 intercompany services from its Brazilian parent. The SpA delivers them; the auditor certifies receipt and the twelve month transfer pricing term starts. In month eight, the SII issues a citación; the SpA has one month to answer, extendable by one more.
  • The SII then assesses US$400,000 (CLP 394,632,000) of single tax on a transfer pricing adjustment. The SpA files reposición within 30 days, which suspends the court term; when it is rejected, it files a claim before the Santiago Tax and Customs Court within the remaining part of the 90 days without paying first, and can appeal any judgment to the Court of Appeals within 15 days.
  • Disputes with Argentine group companies over the same transaction can also be raised in a mutual agreement procedure under the Chile Argentina treaty (see tax treaties); Argentine procedures are covered in the Argentine guide.

Step by step

  1. Keep accounting records and support for at least six years (art. 200).
  2. When a document request arrives, deliver everything at once and obtain the certification, since it starts the SII clock.
  3. Answer a citación within one month, asking for the one month extension if needed.
  4. On an assessment, decide between reposición (30 days) and a direct court claim (90 days); paying within 90 days extends the claim term to one year and stops interest.
  5. For planned transactions with avoidance risk, consider a binding consultation under art. 26 bis.
  6. If you have old tax debts, evaluate the Ley Nº 21.850 Treasury condonation window, open for 180 days from 17 October 2026.

Common traps

  • The six year period applies if a return was not filed at all, so non filing foreign companies with Chilean source income face longer exposure.
  • Late payment of withheld tax detected in an audit doubles the fine range to 20 to 60 percent.
  • Filing a claim does not stop collection unless the court orders suspension.
  • Planners and advisers, not just taxpayers, are fined when a scheme is declared abusive or simulated.
  • Audit terms run from certification of complete delivery, so partial deliveries delay the start and prolong the audit.
