Every private employer in Costa Rica pays an aguinaldo equal to one month of salary, calculated on the average pay of the twelve months to 30 November, paid within the first twenty days of December, exempt from income tax and outside the CCSS contribution base. Workers earn at least two weeks of paid vacation for every fifty weeks of continuous work, which may not be cashed out except on termination and in limited cases. There are nine paid public holidays and three holidays whose pay is not compulsory, and work on a paid holiday is paid double.

The rule

1. Every private employer owes each worker, of any kind and however paid, an annual benefit equal to one month of salary, based on the average ordinary and overtime pay of the twelve months before 1 December; workers with less than a year but at least one month receive a proportional share.
Example: Salary ₡1,500,000 all year: aguinaldo ₡1,500,000. Hired 1 June at ₡1,500,000: six months of pay ₡9,000,000 / 12 = ₡750,000. / About US$3,298.01; part year about US$1,649.00.Ley 2412, Ley de Aguinaldo para la Empresa Privada, as reformed by Ley 3929, art. 1, art. 2 and art. 3, 1967-08-08 official text · verified 2026-10-29

9. Employers may not make workers work on holidays outside the exceptions of art. 150 and 151; one that does is fined and pays double, as for the weekly rest day.

Worked example

  • A worker on ₡1,500,000 a month (US$3,298.01) all year receives an aguinaldo of ₡1,500,000 by 20 December, with no income tax and no CCSS charges on it.

Step by step

  1. Accrue one twelfth of monthly pay each month for the aguinaldo.
  2. Pay the aguinaldo between 1 and 20 December.
  3. Schedule each worker's two weeks within fifteen weeks after the fifty week anniversary.
  4. On termination pay untaken vacation and the proportional aguinaldo whatever the cause.

Common traps

  • The aguinaldo base includes overtime and commissions paid in the twelve months.
  • Paying vacation in cash every year is not allowed outside art. 156.
  • Late aguinaldo lets the worker resign with full severance rights.
