Worked example

  • A foreign equipment maker bids RD$60,900,700 (US$1,000,000.00) on an open tender. It registers provisionally, adds 1% bid security of RD$609,007 (US$10,000.00), wins, and has 10 working days to post 4% performance security of RD$2,436,028 (US$40,000.00). It then completes definitive registration before signing.

Step by step

  1. Get provisional or full registration in the State supplier registry.
  2. Follow calls on the electronic system.
  3. Ask clarifications before 50% of the bid period ends.
  4. Prepare the 1% security with the offer.
  5. Watch the award notice: 10 working days to challenge.
  6. Post performance security on time, or the bid security can be called.

Common traps

  • Ley 47-25 art. 59 factors give a different result than the published table in places, because the Resolution follows treaty lower limits. Use the table.
  • The small business advance and reserve need certification and can leave a foreign bidder out of the reserved share.
  • Bodies with small budgets halve the factors under art. 59 paragraph IV.
  • Filing a challenge does not stop the award; ask for interim measures under art. 211.
  • Public private partnerships do not follow this law; see investing/public-private-partnerships.
