Environmental rules in Panama: impact studies before works start, MiAmbiente sanctions and ten year civil liability

Last verified: 2026-10-29 · Status: Stable

Projects that may create environmental risk need an environmental impact study approved by the Ministry of Environment (MiAmbiente) before execution starts, prepared by certified independent consultants and subject to public participation. Starting a listed project without approval triggers a provisional stoppage. Breaches bring warnings, suspension or fines plus the duty to clean up and compensate, and civil environmental claims can be brought for ten years.

Panama's currency, the balboa (B/.), is at par with the US dollar, which circulates as legal tender; the Superintendencia de Bancos states that the balboa's value is on a par with the US dollar (checked 29 October 2026). USD figures therefore equal the balboa figures.

The rule

1. Public or private activities, works or projects that may generate environmental risk by their nature, features, effects, location or resources require an environmental impact study before execution, including those in the Canal watershed and indigenous comarcas. Permits from other authorities do not imply environmental viability.Texto Único de la Ley 41 de 1998, art. 7, 2016-10-04 official text · verified 2026-10-29
2. The impact assessment process includes citizen participation and four stages: filing the study (for projects on the taxative list in the regulation), review, approval or rejection by MiAmbiente, and follow up of the Environmental Management Plan and the approval resolution.Texto Único de la Ley 41 de 1998, art. 9, 2016-10-04 official text · verified 2026-10-29
3. Studies must be prepared by qualified natural or legal persons independent of the project promoter and certified by MiAmbiente; MiAmbiente publicises filed studies and gives a comment period set by the regulation according to project complexity.
Cost to do it: No fee is stated in the law; MiAmbiente charges evaluation fees (art. 112) and the promoter pays the certified consultant.Texto Único de la Ley 41 de 1998, arts. 11 and 12, 2016-10-04 official text · verified 2026-10-29
4. 6. Sanctions reflect the risk or damage, recidivism, conduct after the event, the size of the investment and the offender's economic situation; the offender must also clean up, restore, mitigate or compensate the damage at its own cost, without prejudice to civil and criminal liability.Texto Único de la Ley 41 de 1998, art. 111, 2016-10-04 official text · verified 2026-10-29
7. Civil environmental actions follow the summary procedure, carry no court costs except for reckless claims, seek restoration or compensation, and prescribe ten years after the damage occurs or becomes known.Texto Único de la Ley 41 de 1998, arts. 113 to 115, 2016-10-04 official text · verified 2026-10-29

Worked example

  • A hotel developer that clears land before MiAmbiente approves its study faces a provisional stoppage under DE 1 de 2023 art. 6, possible fines under art. 107 and the cost of restoring the site under art. 111.
  • A neighbour harmed by a spill discovered in 2026 can sue for restoration or compensation until 2036 (art. 115).

Step by step

  1. Check whether the project appears on the art. 19 list of Decreto Ejecutivo 1 de 2023 as amended in 2024.
  2. Hire a MiAmbiente certified independent consultant to prepare the study.
  3. Budget time for public consultation and MiAmbiente review before any site work.
  4. After approval, implement and monitor the Environmental Management Plan, which MiAmbiente audits.

Common traps

  • Permits from municipalities or sector regulators do not replace environmental approval.
  • Clean up and compensation are owed on top of fines.
  • Any person or civil organisation has standing in environmental proceedings, and claims run for ten years.
