Panama ship registry under Ley 57 de 2008: who can flag a vessel, provisional and permanent documents, cancellation and cabotage

Last verified: 2026-10-29 · Status: Stable

Any person or company of any nationality or domicile can register vessels in Panama's Merchant Marine through a Panamanian lawyer or a consulate, appointing a resident agent. Ships get provisional documents first and then a navigation patent and radio licence valid for up to five years, and remain subject to Panamanian law wherever they sail. The Dirección General de Marina Mercante can refuse vessels harmful to Panama's interests, and Ley 266 de 2021 reserves domestic auxiliary services to Panamanian majority owners.

Panama's currency, the balboa (B/.), is at par with the US dollar, which circulates as legal tender; the Superintendencia de Bancos states that the balboa's value is on a par with the US dollar (checked 29 October 2026). USD figures therefore equal the balboa figures.

The rule

1. Flagging is the act by which Panama admits a vessel to its Merchant Marine; registered ships are subject to Panamanian law wherever they are, and Panama City is the port of registry. Any natural or legal person, with no nationality or domicile requirement, may register one or more vessels.Ley 57 de 6 de agosto de 2008, General de Marina Mercante, arts. 1 and 3, 2008-08-06 official text · verified 2026-10-29
2. The owner files an application, pays the applicable fees, charges and taxes and provides the documents required by the Dirección General de Marina Mercante; AMP may use electronic means. The Directorate may refuse registration if harmful to Panama or the maritime industry, considering safety and pollution conventions, illicit activities including money laundering and illegal fishing, crew labour conditions, the ship's age and record, and political or economic reasons.Ley 57 de 2008, arts. 4 and 5, 2008-08-06 official text · verified 2026-10-29
3. For international service vessels, applications are filed through a Panamanian lawyer at the Directorate, or by the owner or representative at a consulate, a Panamanian commercial office or another authorised entity abroad, or electronically; documents can be deferred for up to 30 days, and the application must include the appointment of a resident agent and prima facie evidence of ownership.Ley 57 de 2008, arts. 13, 14 and 15, 2008-08-06 official text · verified 2026-10-29
4. If a ship has not obtained its permanent navigation patent or radio licence after six months, it gets up to six more months, and further extensions only for justified causes not attributable to the owner; AMP's Board sets surcharges after the second extension. Permanent navigation patents and radio licences are valid for up to five years.Ley 57 de 2008, arts. 24, 25 and 26, 2008-08-06 official text · verified 2026-10-29
5. Ship title, mortgage and related deeds involving Panamanian companies can be registered at the Public Registry without showing the companies' annual tasa única, but it must be shown to the Directorate before a certificate of cancellation from the Panamanian registry is issued.Ley 57 de 2008, art. 7, 2008-08-06 official text · verified 2026-10-29
6. Where there are signs that a vessel has abandoned the Panamanian flag (no renewal of documents, no filings), arrears accrue for only five years, and the Directorate may waive the annual inspection and accident investigation fee if the ship was not in operation.Ley 57 de 2008, art. 52, 2008-08-06 official text · verified 2026-10-29
7. Domestic service vessels need tonnage and valuation, proof of ownership, a construction certificate or cancellation of prior registry, proof of import duty payment or exemption, and, for non commercial use, a sworn private use declaration.Ley 57 de 2008 art. 20 as worded by Ley 4 de 2015 art. 2, art. 20, 2015-02-12 official text · verified 2026-10-29
8. Ley 266 de 2021 regulates cabotage and domestic trade in Panamanian waters and requires companies providing auxiliary maritime services with vessels in those waters to be at least 75 percent owned by Panamanian nationals, with the vessel owned by the applicant or a qualifying Panamanian person.Ley 266 de 2021, art. 1 and art. 63 (new wording of Ley 56 de 2008 art. 43), arts. 1 and 63, 2021-12-23 official text · verified 2026-10-29

Worked example

  • A Greek owner buying a bulk carrier through a Marshall Islands company can flag it in Panama via the consulate in Piraeus, receive provisional documents, and later obtain a navigation patent valid for up to five years.
  • A Panamanian ship owning S.A. behind on its tasa única can still register a mortgage on the ship, but cannot obtain a cancellation certificate until it pays.

Step by step

  1. Appoint a Panamanian lawyer or use a consulate; appoint the resident agent.
  2. File the application with ownership evidence and pay registration fees and annual tax.
  3. Receive provisional patent and radio licence; file the remaining documents within the deadlines.
  4. Obtain the permanent navigation patent and radio licence and renew them before expiry.

Common traps

  • The Directorate can refuse vessels for age, record, illegal fishing or sanctions related political reasons even when the file is complete.
  • Provisional documents cannot be extended indefinitely; repeated extensions carry surcharges and can lead to sanctions.
  • Domestic auxiliary services are reserved to Panamanian majority owned operators.
