Foreign awards go through exequatur before the civil and commercial chamber of the First Instance Court of the Distrito Nacional, in a non contentious procedure, with refusal limited to New York Convention style grounds. Domestic awards are enforced by the first instance court of the seat, and awards from chamber of commerce courts need no recognition at all. Any contest of a foreign award order goes to the court of appeal in sole instance.

Enforcement by award type

Worked example

  • A New York seated ICC award orders a Dominican buyer to pay US$500,000 (about RD$30,429,700). The winner files the original award and contract in Santo Domingo. Once the order issues, it can seize assets anywhere in the country, and a contest goes to the court of appeal.

Step by step

  1. Obtain an original or certified award and clause.
  2. Add a Spanish translation and apostille, as a practical step.
  3. File the petition.
  4. Serve the order and enforce.
  5. Answer any contest at the court of appeal.

Common traps

  • Art. 43 asks for originals, which can be hard to get from foreign institutions.
  • Ley 2-23 art. 10 names exequatur of foreign judgments, not awards, among automatic cassation matters, and art. 44 makes the appeal court ruling last instance. Expect argument on this.
  • The court can refuse on public order by itself. Do not assume the debtor must raise it.
  • If the debtor files for restructuring, enforcement stops under Ley 141-15 art. 54.
