Administrative sanctions

Worked example

  • A company that keeps skipping the Banco Central foreign currency commitment form risks at most the minor ceiling of RD$500,000 (about US$8,210.09) per infraction, plus publication. The fine depends on net assets under the Reglamento de Sanciones.

Step by step

  1. Keep a calendar of ProDominicana and Banco Central filings.
  2. Answer any request from the authorities on time.
  3. Do not pay informal currency dealers.
  4. Keep exchange receipts for at least the longest limitation period.

Common traps

  • The net asset scale for reporting fines is in the Reglamento de Sanciones of 18 December 2003 and was not reviewed in this page.
  • Civil and criminal exposure can apply on top: administrative sanctions do not rule out penal ones (Ley 183-02 art. 66 literal b).
  • Using an unlicensed dealer leaves no receipt for the investment file.
