Selling property: tax on gains

Argentina. For full detail on Argentina, go to The Argentine Thread.

Last verified: 2026-10-30 · Status: Changing

Since June 2026, an individual seller pays a final 10% on the real estate gain, due within six months of the sale. Reinvesting the whole amount in a new habitual home within six months exempts the gain, and sellers over 65 are exempt on their habitual home. Companies pay the general rate, but companies that only hold non commercial real estate can use the 10%. The seller must also file the discharge at DGII.

USD figures use the Banco Central de la República Dominicana reference selling rate of RD$60.9007 per US dollar for 29 October 2026, the latest row in its published rate file on the verification date, rounded to the cent.

Worked example

  • An individual sells a rental apartment for RD$35,000,000 (about US$574,706.04), with an inflation adjusted cost of RD$20,000,000 (about US$328,403.45). The gain is RD$15,000,000 (about US$246,302.59) and tax is RD$1,500,000 (about US$24,630.26), due within six months. If it were the habitual home and RD$17,500,000, half the amount received, went into a new habitual home in time, half the gain would be exempt, leaving RD$750,000 (about US$12,315.13).

Step by step

  1. Work out adjusted cost from the purchase file.
  2. Sign, stating the means of payment.
  3. Request discharge at DGII, with form FI-DVB-012.
  4. Pay the 10% within six months.
  5. Move proceeds with bank support. See fx/capital-contributions-and-repatriation.

Common traps

  • Art. 296-1 speaks of individuals without limiting it to residents, so a non resident seller should expect it to apply.
  • DRAFT, NOT IN FORCE: art. 11 of the draft regulation of Ley 30-26 accepts only completed purchases as reinvestment, not options, promises or off plan contracts.
  • A sale between close relatives needs a DGII certificate that no gift is presumed. See taxes/inheritance-and-gift-tax.
  • The Ley 171-07 50% relief predates the 10% rate, and how it combines with art. 296-1 was not found in official guidance.
  • Shares of a company holding Dominican assets are a separate question. See taxes/capital-gains.
