Immediate investment authorization in Mexico: the May 2026 fast track decree, the national investment window and the Investment Committee

Last verified: 2026-10-26 · Status: Changing

A decree published in the DOF on 4 May 2026 lets large or strategic private projects get a single authorization from an inter ministerial Investment Committee and start work while sector permits are still in process. It covers projects in a declared development pole, projects of MXN 2,000 million (about USD 107,159,314) or more, and projects in strategic sectors such as data centers, semiconductors, automotive, medical devices, pharmaceuticals, aerospace, energy and chemicals; mining, financial and public or mixed investment projects are excluded. Applications go through the National Digital Investment Window (inversiones.gob.mx); the Committee decides within 30 business days, and the authorization lasts one year, renewable twice if the project reaches 90 percent of committed progress.

USD figures use MXN 18.6638 per US dollar, the Federal Reserve H.10 noon buying rate for 23 October 2026 (FRED series DEXMXUS), the latest observation available on 26 October 2026. Conversions are for orientation only.

The rule

1. Which projects qualify. The decree covers private investment projects that meet any one of three tests: (1) they are located in a Development Pole for Wellbeing, an Economic Development Pole for Wellbeing or a Circular Economy Pole for Wellbeing declared by the Interoceanic Corridor of the Isthmus of Tehuantepec or by the Ministries of Economy or Environment; (2) they amount to MXN 2,000,000,000 or more; or (3) they focus on strategic sectors or others the Investment Committee determines, including technology infrastructure, data processing centers, textiles and apparel, semiconductor and microelectronics design and manufacturing, automotive and auto parts, medical devices, pharmaceuticals and biopharmaceuticals, aerospace, energy and chemicals. Mining and financial projects, and projects that are public or mixed investment, are excluded.
Cost to do it: The decree promises authorization without bureaucratic cost; no government fee for the authorization appears in the official summaries consulted. The real cost is preparing the project file.
Example: A MXN 2,500,000,000 auto parts plant in Nuevo León qualifies on both the amount test and the sector test. / MXN 2,500,000,000 is about USD 133,949,142; the MXN 2,000,000,000 threshold is about USD 107,159,314.Decreto para la autorización inmediata de inversiones, DOF 4 May 2026 (evening edition), Provisions on beneficiaries and exclusions (article numbering not reachable on dof.gob.mx on the verification date; terms as summarized by INDETEC), 2026-05-04 official text · verified 2026-10-26 · changed: New fast track authorization regime published in the DOF evening edition of 4 May 2026.
2. How to apply and how long it takes. The application is filed through the National Digital Investment Window (Ventanilla Digital Nacional de Inversiones) with detailed project information: corporate documents, technical description, investment schedule, sources of financing, employment impact and regulatory compliance. The Investment Committee must resolve within 30 business days. If the file is incomplete or inconsistent, the authority has 10 days to request the missing information and gives the applicant 5 days to provide it. The Office of the President identifies the window as www.inversiones.gob.mx.
Cost to do it: Professional cost of assembling the project file (corporate, technical, financial and regulatory); no government fee stated.
Example: An application filed on Monday 2 November 2026 has a 30 business day clock, which runs to mid December 2026 depending on official holidays. / Not applicable.Decreto para la autorización inmediata de inversiones, DOF 4 May 2026 (evening edition), Provisions on the application and resolution procedure (article numbering not reachable on dof.gob.mx on the verification date; terms as summarized by INDETEC), 2026-05-04 official text · verified 2026-10-26
3. What the authorization allows and how long it lasts. Once the Committee authorizes the project, the investor may start executing it immediately while it keeps obtaining the permits, licenses and authorizations required by the applicable laws. The authorization is valid for one year from issue and may be renewed up to twice for equal periods if the project has met at least 90 percent of the progress committed for the period.
Cost to do it: No renewal fee stated; renewal depends on meeting the 90 percent progress test.
Example: A project authorized on 15 December 2026 must show at least 90 percent of its committed first year progress to renew in December 2027, and can run under the authorization until December 2029 at most. / Not applicable.Decreto para la autorización inmediata de inversiones, DOF 4 May 2026 (evening edition), Provisions on the effects and validity of the authorization (article numbering not reachable on dof.gob.mx on the verification date; terms as summarized by INDETEC), 2026-05-04 official text · verified 2026-10-26
4. Duties after authorization. The investor must start the project immediately, file quarterly progress reports through the window against the schedule it submitted (if a quarterly report is missing, the authorization is suspended until it is filed), report any change to the authorized project through the window at least 10 business days before making it, and commit to contract local suppliers for at least 20 percent of the total investment amount.
Cost to do it: Ongoing compliance cost of quarterly reporting; the local supplier commitment shapes procurement.
Example: For a MXN 2,500,000,000 plant, at least MXN 500,000,000 of the investment must go to local suppliers. / Local supplier commitment of about USD 26,789,828 on a project of about USD 133,949,142.Decreto para la autorización inmediata de inversiones, DOF 4 May 2026 (evening edition), Provisions on investor obligations (article numbering not reachable on dof.gob.mx on the verification date; terms as summarized by INDETEC), 2026-05-04 official text · verified 2026-10-26
5. Who decides. The Office of the President states that the Investment Committee is inter institutional and made up of the Ministries of Economy, Finance, Energy, Environment and Natural Resources, and Anticorruption and Good Government, the Digital Transformation and Telecommunications Agency and the Regional Economic Development and Relocation Advisory Council (CADERR), working with the Presidential Office for Investment Promotion, which guides investors. By 10 June 2026, 22 investment projects worth more than USD 8 billion had received approval. The first stage serves projects above MXN 2,000 million, and the amount is to be lowered later to serve medium sized companies.
Cost to do it: No fee.
Example: A pharmaceutical plant application is reviewed once by the Committee, where Economy, Finance, Environment and the other members sit together, rather than ministry by ministry. / 22 projects worth more than USD 8 billion approved by 10 June 2026.Office of the President of Mexico, release of 10 June 2026 on the Presidential Office for Investment Promotion, Release (Investment Committee membership, first results and stages), 2026-06-10 official text · verified 2026-10-26
6. Other private investments and related measures. When announcing the decree on 4 May 2026, the Office of the President said that for private investments the maximum resolution time for all federal procedures will be 90 days, and that a separate measure creates a single window and a single file for foreign trade procedures. The fast track authorization is an administrative measure and gives no tax benefit by itself; tax incentives come from separate decrees, such as the Plan México decree and the decree on tax incentives in the Economic Development Poles for Wellbeing (DOF 22 May 2025).
Cost to do it: Not applicable.
Example: A data center authorized under the decree still applies separately for the Plan México certificate before using the immediate deduction on its servers. / Not applicable.Office of the President of Mexico, release of 4 May 2026 on actions to facilitate investment; Decreto para la autorización inmediata de inversiones, DOF 4 May 2026 (evening edition), Release (90 day federal procedures goal, foreign trade single window); decree as a whole (no tax benefits, per INDETEC), 2026-05-04 official text · verified 2026-10-26

Immediate investment authorization at a glance

Worked example

  • A foreign electronics group plans a MXN 2,500,000,000 (about USD 133,949,142) semiconductor packaging plant in Jalisco through a Mexican subsidiary.
  • It files through inversiones.gob.mx with its corporate documents, technical description, investment schedule, financing and hiring plan. The authority asks within its 10 day window for an updated regulatory compliance plan, and the company answers within 5 days.
  • Within 30 business days the Investment Committee authorizes the project. Civil works start while the environmental impact, land use and construction permits continue in parallel.
  • The company files quarterly progress reports, plans at least MXN 500,000,000 (about USD 26,789,828) of purchases from local suppliers and diarizes the one year renewal test of 90 percent progress.
  • Separately, it registers the foreign investment in the RNIE and applies for the Plan México certificate for its new equipment.

Step by step

  1. 1. Check eligibility: declared pole location, MXN 2,000 million or more, or a strategic sector; confirm the project is not mining, financial, public or mixed investment.
  2. 2. Build the project file: corporate documents, technical description, investment schedule, sources of financing, employment impact and regulatory compliance plan.
  3. 3. File through the National Digital Investment Window and be ready to answer any information request within 5 days.
  4. 4. After authorization, start works at once, keep processing the sector permits and file quarterly progress reports on time.
  5. 5. Give at least 10 business days notice through the window before changing the project.
  6. 6. Before the first year ends, check progress against the 90 percent test and request renewal.

Common traps

  • Permits are still required. The authorization lets work start, but environmental, land use, construction and sector permits must still be obtained under their own laws; building ahead of them carries the risk that a later permit is denied or conditioned.
  • A missed quarterly report suspends the authorization until it is filed.
  • Local content is a commitment. The 20 percent local supplier share must be designed into procurement from day one.
  • Mining, financial and public or mixed investment projects cannot use this route.
  • No tax benefit. Companies that assume the authorization brings the Plan México or development pole incentives lose them if they do not apply for those separately.
