Environmental certification and prior consultation for investment projects in Peru: SEIA categories, SENACE and Ley Nº 29785
Last verified: 2026-10-28 · Status: Stable
No project covered by Peru's environmental impact assessment system (SEIA) can start, and no authority can license it, without a prior environmental certification. Projects are classified as Category I (environmental impact statement), II (semi detailed EIA) or III (detailed EIA), and detailed EIAs for national and multiregional projects are approved by SENACE. When a State measure, such as a concession or permit, may directly affect the collective rights of indigenous peoples, the State must run a prior consultation, capped at 120 calendar days for the core stages, whose agreements bind both sides.
USD figures use S/ 3.452 per US dollar, the banking system selling rate published by the Superintendencia de Banca, Seguros y AFP for 27 October 2026 and shown in the Banco Central de Reserva del Perú statistics series PD04640PD. Amounts in UIT use the 2026 tax unit of S/ 5,500 (Decreto Supremo Nº 301-2025-EF, as cited in SUNAT Resolución de Superintendencia Nº 000016-2026). Amounts that the law sets in US dollars are quoted as written. Conversions are for orientation only.

The rule
| Category | Instrument | Expected impact | Who approves |
|---|---|---|---|
| I | Declaración de Impacto Ambiental (DIA) | No significant negative impacts | Sector, regional or local competent authority; certification issued on classification |
| II | EIA semidetallado (EIA-sd) | Moderate impacts mitigable with easily applicable measures | Competent sector, regional or local authority |
| III | EIA detallado (EIA-d) | Significant negative impacts needing in depth analysis | SENACE for national and multiregional projects in transferred sectors (Ley 29968 art. 1.3) |
SEIA categories (Ley 27446 art. 4 as amended by DL 1078).
Worked example
- A foreign developer plans a 200 MW solar plant spanning two regions. Its classification proposal concludes it may cause significant impacts, so it prepares a detailed EIA (Category III). Where the sector's EIA-d function has been transferred to SENACE, SENACE first approves the terms of reference and then the study (Ley 27446 art. 8.2 b; Ley 29968 art. 1.3).
- Until SENACE issues the approving resolution, no authority may grant the permits that let construction start (Ley 27446 art. 3), so the EIA path drives the project timeline and financing conditions precedent.
- If the site overlaps lands of an indigenous community and the measure (for example a concession or authorization) may directly affect its collective rights, the competent ministry runs a prior consultation whose core stages may last up to 120 calendar days (DS 001-2012-MC art. 24); any agreement reached binds the State and the community (Ley 29785 art. 15).
Step by step
- Check whether the activity is on the SEIA inclusion list and which authority is competent (SENACE, the sector ministry or a regional or local government).
- File the classification proposal with the evaluation request; obtain the DIA directly for Category I or approval of the terms of reference for Categories II and III.
- Prepare the study and present and execute a citizen participation plan; for semi detailed and detailed EIAs the authority runs a formal public consultation, and for a detailed EIA a public hearing must be held at least 5 days before that consultation period ends (Ley 27446 art. 14 b) to d)).
- Obtain the certification resolution before applying for construction or operating licenses.
- Map indigenous peoples in the area of influence using the official database of indigenous peoples (Ley 29785 art. 20) and ask the promoting entity whether the measure requires prior consultation.
- Plan for the consultation timeline (up to 120 calendar days for the core stages) and for the obligations that agreements create.
Common traps
- Starting works or obtaining permits without certification breaches Ley 27446 art. 3; authorities are barred from licensing uncertified projects, and the permit itself is exposed.
- Prior consultation is a State duty (Ley 29785 art. 2). A private agreement with a community does not replace it.
- Agreements reached in consultation are binding and enforceable administratively and in court (art. 15), so commitments offered during dialogue become obligations.
- One final provision of the consultation regulation was annulled with retroactive effect by a popular action ruling published 14 January 2022 (Exp. 29126-2018), so use an updated text of DS 001-2012-MC.
- The SEIA regulation and sector regulations set the review terms for each category (Ley 27446 art. 11.3). The official text of the general regulation (DS 019-2009-MINAM) on gob.pe is largely a scanned image, so confirm terms with the competent authority.
