Social security in Peru: 9 percent EsSalud, occupational risk insurance (SCTR), and the ONP and AFP pension systems after the 2024 reform
Last verified: 2026-10-28 · Status: Changing
Employers pay 9 percent of pay to EsSalud for health cover and must buy the occupational risk insurance (SCTR) for workers in high risk activities; pensions are funded by workers. The employer withholds either at least 13 percent for the public ONP system or, for private AFP members, 10 percent to the individual account plus an insurance premium and commission. The 2024 pension reform, Ley 32123, in force since its regulation was published on 5 September 2025, sets retirement at 65, makes affiliation mandatory from age 18 and phases in contributions for independent workers, while an employer contribution is only under study.

Worked example
- A Mexican manufacturer's Arequipa plant hires a technician on S/ 5,000 a month (about US$1,448.44).
- The plant's activity is on the high risk list, so it buys SCTR health and pension cover for the technician on top of the S/ 450.00 monthly EsSalud contribution (Ley 26790 art. 6 and 19).
- The technician chose an AFP, so the plant withholds S/ 500.00 for the individual account plus the AFP's insurance premium and commission (Ley 32123 art. 8.2).
- A new 18 year old apprentice who does not choose a system is placed in the ONP by default (Ley 32123 art. 29.1).
Step by step
- Register each worker in the electronic payroll and with EsSalud from the first day (Ley 26790).
- Record each worker's pension choice; for new workers who do not choose, apply the default the law sets (Ley 32123 art. 29).
- Each month declare and pay the 9 percent EsSalud and the withheld ONP contribution through SUNAT, and pay AFP contributions under SPP rules (gob.pe ONP page; Ley 32123 art. 8 and 9.7).
- If the activity is high risk, buy SCTR cover before the worker starts (Ley 26790 art. 19).
- Track the start date of the independent worker contribution and prepare to withhold it on fees paid to contractors (Ley 32123 art. 9.4).
Common traps
- Missing SCTR cover for high risk work leaves the employer exposed to the cost of the benefits the insurance would have paid (Ley 26790 art. 19).
- The law contemplates a future employer pension contribution; budget sensitivity to it, but it needs a new law first (Ley 32123 art. 8.4 and 8.5).
- Companies that keep accounts become withholding agents for independent workers' pension contributions and are jointly liable for unpaid amounts (Ley 32123 art. 9.4 and 9.5).
