Working hours: 48 a week, voluntary overtime with a 25 to 35 percent premium
Last verified: 2026-10-29 · Status: Stable
Abroad salaried staff often work open ended hours; in Peru the ordinary maximum is 8 hours a day or 48 a week, and overtime is voluntary and paid with at least 25 percent extra for the first two hours and 35 percent after that. Work on the weekly rest day or a public holiday without a substitute day pays a 100 percent surcharge, and night workers cannot earn less than the minimum wage plus 35 percent. Managers, unsupervised staff and intermittent watch or custody work are outside the maximum, and employers must record overtime.

Overtime for a worker paid S/ 120 for an 8 hour day (hourly value S/ 15; USD at S/ 3.452)
Worked example
- Night shift floor: S/ 1,230 x 1.35 = S/ 1,660.50 a month, about US$481.03.
Step by step
- Set ordinary schedules within 8 hours a day or 48 a week, or an averaged compensatory schedule.
- Give eight days' notice to the union or workers before changing working days, shifts or schedules (DS 007-2002-TR art. 2).
- Put in place a reliable time recording system and pay overtime monthly at 25 and 35 percent.
- Classify management and unsupervised positions carefully and document why they are outside the maximum.
- Pay rest day and holiday work at double unless a substitute day off is given in the same week.
Common traps
- Overtime worked without written approval is still owed if the worker proves it.
- Labelling a job as managerial does not remove it from the maximum if the person is in fact supervised.
- A broken or missing time record does not prevent overtime claims; it only weakens the employer's defence.
- Imposing overtime adds a 100 percent indemnity on top of the overtime pay.
