Last verified: 2026-10-26 · Status: Changing

Every property pays an annual tax on its SII fiscal assessment: homes pay 0.893 percent on the assessed value between the exempt amount (CLP 61,711,570 from 1 July 2026) and CLP 220,398,431, and 1.042 percent above that, while offices, shops and land pay 1.042 percent, plus a 0.025 percent fiscal surcharge on the top band. Vacant urban lots pay double. Non agricultural values will be reappraised from 1 January 2027, and from the same date owners aged 65 or over are fully exempt on their main home.

USD figures use the Central Bank exchange rate of CLP 986.58 per US dollar published in the Diario Oficial for 23 October 2026 (CVE 2891564). The rule

1. Property tax is levied on the fiscal assessment. The law sets 1 percent a year for agricultural property, 1.4 percent for non agricultural property and, for homes, a lower rate up to a threshold and the higher rate above it; when a reappraisal would raise total national collections by more than 10 percent in the first half year, the rates are cut proportionally by supreme decree. A fiscal surcharge of 0.025 percent is added on top of the highest non agricultural rate. Since 1 January 2022 the decree sets 1.042 percent for non agricultural property and, for homes, 0.893 percent up to the rate change threshold and 1.042 percent above it.
Cost to do it: A home assessed at CLP 300,000,000 pays about CLP 2,266,422 a year; an office assessed at CLP 500,000,000 pays CLP 5,335,000.
Example: Home assessed at CLP 300,000,000 (second half 2026 values): CLP 1,417,074 on the first band, CLP 829,448 on the excess and CLP 19,900 of fiscal surcharge, total CLP 2,266,422 a year. / About US$2,297 a year for the home and US$5,408 for the office, before municipal waste charges.Ley Nº 17.235 sobre Impuesto Territorial, text set by DFL Nº 1 of 1998, Ministerio de Hacienda (Diario Oficial 16 December 1998); Decreto Supremo Nº 437 of 2022, Ministerio de Hacienda (Diario Oficial 12 April 2022), Ley Nº 17.235 art. 7; DS Nº 437 art. 1 and art. 2, 2022-04-12 official text · verified 2026-10-26
2. Homes have an exempt amount deducted from the assessment, and agricultural property has its own exempt amount; both thresholds and all assessments are indexed every half year to consumer prices. From 1 July 2026 the SII applies an exempt amount of CLP 61,711,570 for homes, a rate change threshold of CLP 220,398,431, an exempt amount of CLP 50,177,135 for agricultural land and CLP 13,855,937 for the farm house, and a full exemption by operation of law for non agricultural property assessed up to CLP 273,799. A home partly used for other purposes keeps a full exemption if its assessment is within the residential exempt amount and the owner, an individual, lives there. Exemptions cannot be combined: the most favourable one applies.
Cost to do it: A home assessed at or below CLP 61,711,570 pays no property tax.Ley Nº 17.235, text set by DFL Nº 1 of 1998; SII, Reajustes y exenciones de Impuesto Territorial (second half 2026), Art. 2 and art. 9, 1998-12-16 official text · verified 2026-10-26
3. The SII reappraises agricultural and non agricultural property every four years, simultaneously across the country, and the first half year of a reappraisal may not raise national collections by more than 10 percent; increases above 25 percent for an individual property are phased in. Ley Nº 21.806 suspended the reappraisals due in 2026 (non agricultural) and 2028 (agricultural): the non agricultural reappraisal takes effect on 1 January 2027 and the agricultural one on 1 January 2029, and the four year cycle runs from those dates.Ley Nº 17.235, text set by DFL Nº 1 of 1998; Ley Nº 21.806 (Diario Oficial 5 February 2026), Ley Nº 17.235 art. 3; Ley Nº 21.806 art. 72, 2026-02-05 official text · verified 2026-10-26 · changed: Ley Nº 21.806 (Diario Oficial 5 February 2026) moved the non agricultural reappraisal from 2026 to 1 January 2027 and the agricultural one from 2028 to 1 January 2029.
4. The tax is paid in four instalments in April, June, September and November unless the President sets other dates under art. 36 of the Código Tributario, and the whole year may be paid in April. It is paid by the owner or the occupant (usufructuary, tenant or holder), though the owner remains liable; tenants are not liable for tax accrued before their contract. Co owners are jointly liable. Concessionaires and occupants of public land pay the tax on the land they occupy.Ley Nº 17.235, text set by DFL Nº 1 of 1998, Art. 22, art. 25, art. 26 and art. 27, 1998-12-16 official text · verified 2026-10-26
5. Non agricultural property in urban areas that is a vacant lot, an abandoned property or a gravel pit pays a surcharge of 100 percent of the applicable rate. The surcharge does not apply in urban extension or urbanisable areas, outside the area served by drinking water and sewerage concessionaires (proved with the utility's certificate), or for ten years after a disaster or other cause not attributable to the owner destroys or makes the building unusable.
Cost to do it: A vacant urban lot assessed at CLP 200,000,000 pays 2.084 percent instead of 1.042 percent: CLP 4,168,000 instead of CLP 2,084,000 a year, before the 0.025 percent fiscal surcharge.Ley Nº 17.235, text set by DFL Nº 1 of 1998, art. 8 as amended by Ley Nº 20.280, Art. 8, 2008-07-04 official text · verified 2026-10-26
6. From 1 January 2027, property owned by individuals aged 65 or over is fully exempt if it is their main home (vivienda principal), with parking spaces and storage units at the same address. The exemption covers one home nationwide, is claimed through an annual sworn declaration, requires the owner to be up to date on municipal waste charges and the prior year's property tax, extends to co owned homes where all co owners are individuals and one who lives there holds at least 50 percent, and to mixed use buildings at least 50 percent residential. It does not apply to a home bought from a related party in the prior three years unless non tax reasons are proved. False declarations are fined 300 percent of the tax avoided and bar the benefit for ten years. The SII must also publish its valuation methodology and parcel maps in open formats.Ley Nº 21.850, Para la reconstrucción nacional y el desarrollo económico y social (Diario Oficial 17 October 2026), Art. 10 (new art. 16 bis and letter F of Part I of the Cuadro Anexo of Ley Nº 17.235); eighth and nineteenth transitory articles, 2026-10-17 official text · verified 2026-10-26 · changed: New exemption for owners aged 65 or over on their main home, in force 1 January 2027, added by Ley Nº 21.850 of 17 October 2026.

Worked example

  • An investor owns an office assessed at CLP 500,000,000 and an apartment assessed at CLP 300,000,000. The office pays CLP 5,210,000 plus CLP 125,000 of fiscal surcharge; the apartment pays CLP 2,266,422. Together about CLP 7,601,422 a year (US$7,705), in four instalments. A company landlord may credit the tax against first category tax only in the cases the income tax law allows (see real-estate/rental-income-tax).

Step by step

  1. Look up the property's role number (rol) and fiscal assessment on the SII site before buying, and ask the seller for proof that instalments are paid.
  2. Diary the April, June, September and November instalments; the surcharge on large holdings is billed with them (see real-estate/property-tax-surcharge).
  3. Declare improvements to the SII so they enter the assessment; declared improvements also count in the tax cost on sale (DL Nº 824 art. 17 Nº 8 b).
  4. Model the 1 January 2027 reappraisal: assessments and thresholds will change, and so will the surcharge bands.
  5. Owners aged 65 or over should file the SII sworn declaration for the main home exemption once the SII publishes the procedure.

Common traps

  • The tenant can be asked to pay, but the owner stays liable, and the tax is a charge the buyer should clear at closing.
  • Residential parking and storage units outside the exemption are taxed at the non residential 1.042 percent rate.
  • A vacant urban lot held for future development pays double rate unless it falls in an exception.
  • The new senior exemption covers only one main home and is lost if waste charges fall into arrears.
