Foreign employees become Colombian tax residents after more than 183 days in Colombia within any 365 day period, and residents are taxed on worldwide income; non residents pay a flat 35 percent on Colombian source income, which includes salaries for work done in Colombia. Foreign employees under a Colombian employment contract are generally affiliated to pensions, but those covered by a home country regime may stay out; this rule continues in the 2024 pension reform taking effect on 1 April 2027. Colombia has signed social security agreements with Spain, Argentina, Chile and Uruguay that let contributions in both countries count toward a pension.

USD figures use the TRM (tasa representativa del mercado) of COP 3,157.94 per US dollar valid on 27 October 2026, from the official TRM series of the Superintendencia Financiera on the national open data portal (datos.gov.co). Peso thresholds use the 2026 minimum wage of COP 1,750,905 (Decreto 1469 de 2025) and fines use the 2026 UVT of COP 52,374 (DIAN Resolución 000238 de 2025). Visa fees are fixed in US dollars or euros; Cancillería sets its own peso conversion rate every four months, so peso amounts for visa fees are orientation only.

The rule

1. Tax residence test. An individual is resident for tax purposes if present in Colombia, continuously or not, for more than 183 calendar days, including entry and exit days, within any period of 365 consecutive days; where the stay spans two tax years, residence applies from the second year. Residents (nationals or foreigners) are taxed on Colombian and foreign source income and gains; non residents only on Colombian source income.
Cost to do it: No fee; compliance cost of a Colombian return.
Example: An executive arriving 1 August 2026 who stays through March 2027 passes 183 days within 365 days and is resident from 2027. / Same.Estatuto Tributario (Decreto 624 de 1989), art. 9 and art. 10 as amended by Ley 1607 de 2012 art. 2, Art. 9 and 10 num. 1, 2012-12-26 official text · verified 2026-10-27
2. Source of employment income and non resident rate. Wages, commissions and fees are Colombian source income when the work is done in Colombia. Non resident individuals pay a single rate of 35 percent on their Colombian source taxable income; foreign professors hired for up to 182 days by higher education institutions pay 7 percent, withheld at payment.
Cost to do it: 35 percent of taxable Colombian source income for non residents.
Example: A non resident consultant paid COP 50 million for work done in Bogotá owes COP 17.5 million. / About US$15,833 of income and US$5,542 of tax at the TRM.Estatuto Tributario (Decreto 624 de 1989), art. 24 num. 5 and art. 247 as amended by Ley 1819 de 2016 art. 10, Art. 24 num. 5 and 247, 2016-12-29 official text · verified 2026-10-27
3. Pension affiliation of foreign employees. Employees under an employment contract are mandatory pension affiliates. Foreigners who stay in Colombia under an employment contract and are not covered by any regime in their country of origin or elsewhere are listed among voluntary affiliates; foreigners covered abroad may therefore stay outside the Colombian pension system. The 2024 pension reform keeps the same rule; its entry into force was suspended in June 2025 and, after the Constitutional Court ruling C-264 of 25 August 2026, the articles upheld apply from 1 April 2027.
Cost to do it: Contribution rates are on the social security page; no immigration fee.
Example: A German assignee who keeps German statutory pension coverage documents that coverage to stay out of the Colombian pension system. / Same.Ley 100 de 1993, art. 15 as amended by Ley 797 de 2003 art. 3; Ley 2381 de 2024, art. 12 num. 8 and art. 94, Ley 100 art. 15 num. 1 and 2; Ley 2381 art. 12 num. 8 and 94, 2024-07-16 official text · verified 2026-10-27 · changed: Ley 2381 de 2024 (pension reform) enters into force on 1 April 2027 after Sentencia C-264 de 2026 of 25 August 2026; it repeats the foreign worker rule in art. 12 num. 8.
4. Social security agreements. Colombia has signed social security agreements with Spain, Uruguay, Argentina and Chile that let each party's nationals have contribution periods in both systems recognised for pensions; the Spain agreement was approved by Ley 1112 de 2006. Where such an agreement or a multilateral agreement binds both states, its rules apply to visa holders.
Cost to do it: No fee; certificates from the home institution may be needed.
Example: An Argentine worker in Colombia can have years contributed in Argentina counted under the agreement. / Same.Decreto 2710 de 2010 (considerations); Resolución 5477 de 2022 art. 122, Decreto 2710 considerandos; Res. 5477 art. 122, 2010-07-28 official text · verified 2026-10-27

Worked example

  • A Spanish engineer is seconded to Colombia from 1 March 2026 for 14 months under a Colombian employment contract paying COP 25 million a month (about US$7,917).
  • By the start of September 2026 the engineer has spent more than 183 days in Colombia within 365 days; because the stay spans 2026 and 2027, residence applies from 2027, when worldwide income becomes taxable in Colombia.
  • For any period treated as non resident, Colombian source salary is taxed at 35 percent: on COP 25 million that is COP 8.75 million (about US$2,771) a month before any relief.
  • On pensions, the Colombia Spain social security agreement lets contributions in both countries count; the employer confirms the engineer's coverage position before payroll starts.

Step by step

  1. Track days of presence for each assignee from the first entry.
  2. Decide residence position for each year and plan tax filings accordingly.
  3. Check whether the home country has a social security agreement with Colombia and obtain coverage certificates.
  4. Set up payroll withholding and social security affiliation on day one.

Common traps

  • Entry and exit days count toward the 183 days (art. 10).
  • Non resident salaries are taxed at a flat 35 percent with no progressive brackets (art. 247).
  • Being covered by a home pension scheme must be documented; otherwise affiliation applies.
  • The pension reform start date has moved several times; check before 1 April 2027.
