Colombia's protection of foreign investors rests on four layers: the Constitution gives foreigners the same civil rights and guarantees as Colombians, protects acquired rights against later laws and allows expropriation only for public utility with prior compensation; economic activity needs no prior permit unless a law requires it; registered foreign investment carries exchange rights (remitting profits and sale or liquidation proceeds in freely convertible currency) whose conditions may not be worsened after registration except temporarily if reserves fall below three months of imports; and Colombia has investment treaties and free trade agreement investment chapters in force with countries including Canada, Chile, China, Spain, France, India, Japan, Switzerland and the United States, enforceable through ICSID. Colombia has no investment treaty with Argentina on the Ministry of Commerce list.

The rule

1. Foreigners enjoy in Colombia the same civil rights as Colombians, although the law may, for reasons of public order, subject to special conditions or deny the exercise of particular civil rights to foreigners; foreigners also enjoy in Colombian territory the guarantees granted to nationals, save limits set by the Constitution or the law.Constitución Política de Colombia de 1991, Art. 100, 1991-07-20 official text · verified 2026-10-27
2. Private property and other rights acquired under civil law are guaranteed and cannot be ignored or infringed by later laws; where a law passed for public utility or social interest conflicts with private rights, the private interest yields. Expropriation is allowed for reasons of public utility or social interest defined by the legislature, by court judgment and with prior compensation set considering the interests of the community and of the affected party; where the legislature so provides it may be done administratively, subject to later challenge in the administrative courts, including on price. Monopolies may be created only as a revenue source, for public or social interest and by law, and such a law may not apply until those deprived of a lawful activity have been fully compensated.Constitución Política de Colombia de 1991, art. 58 as amended by Acto Legislativo 1 de 1999 art. 1; art. 336, Art. 58 and art. 336, 1991-07-20 official text · verified 2026-10-27
3. Economic activity and private initiative are free within the limits of the common good, and no one may demand prior permits or requirements without legal authorization. Free economic competition is a right of all that entails responsibilities, and the State, by law, prevents obstruction of economic freedom and controls abuse of dominant positions.Constitución Política de Colombia de 1991, Art. 333, 1991-07-20 official text · verified 2026-10-27
4. Foreign capital may be invested in all sectors of the economy except defence and national security and the processing, disposal and dumping of toxic, hazardous or radioactive waste not produced in Colombia, and, save special rules, foreign investment needs no authorization. Investors must appoint an attorney in fact in Colombia (portfolio investment always acts through a supervised administrator).Decreto 1068 de 2015, as replaced by Decreto 119 de 2017 (26 January 2017), Art. 2.17.2.2.2.1, art. 2.17.2.2.2.2 and art. 2.17.2.2.2.3, 2017-01-26 official text · verified 2026-10-27
5. Once the investment is made and its registration declaration filed with Banco de la República, the investor may reinvest profits or keep undistributed profits with transfer rights, capitalize amounts with transfer rights, remit abroad in freely convertible currency the proven net profits of its investment, and remit abroad the proceeds of selling the investment in Colombia, liquidating the company or portfolio or reducing its capital. The reimbursement and profit remittance conditions in force on the date of registration may not be changed to the investor's detriment, except temporarily when international reserves are below three months of imports.Decreto 1068 de 2015, as replaced by Decreto 119 de 2017, Art. 2.17.2.2.3.1 and art. 2.17.2.2.3.2, 2017-01-26 official text · verified 2026-10-27
6. Save for international treaties or conventions in force, disputes arising from the foreign investment regime are governed by Colombian law, and everything relating to foreign investment is also subject to Colombian courts and arbitration rules, without prejudice to actions before foreign jurisdictions, unless the parties agreed to international arbitration.Decreto 1068 de 2015, as replaced by Decreto 119 de 2017, Art. 2.17.2.2.4.1, 2017-01-26 official text · verified 2026-10-27
7. The Ministry of Commerce, Industry and Tourism lists Colombia's international investment agreements in force, including bilateral investment treaties and investment chapters of free trade agreements, among them those with the EFTA states (Switzerland and Liechtenstein from July 2011, Norway from September 2014, Iceland from October 2014), Canada (August 2011), Chile (May 2009), China (July 2012), Spain, France, India (July 2012), Japan (September 2015), Peru and Switzerland (October 2009), and the United States trade promotion agreement, and agreements signed but not yet in force with the United Arab Emirates (signed 12 November 2017), a new agreement with Spain (signed 16 September 2021) and Turkey (signed 28 July 2014). The list contains no agreement with Argentina. Colombia is a contracting state of the ICSID Convention, in force for it since 14 August 1997.Ministerio de Comercio, Industria y Turismo, list of international investment agreements; ICSID/3 list of contracting states (16 August 2026), Ministry list, agreements in force and signed; ICSID/3, Colombia entry, 2026-08-16 official text · verified 2026-10-27

Layers of protection for a foreign investor in Colombia, with the official source.

Worked example

  • A Canadian mining investor registers its capital contributions with Banco de la República. Its right to remit profits and sale proceeds is fixed as of registration and can only be curtailed temporarily if reserves fall below three months of imports (Decreto 1068 art. 2.17.2.2.3.2). If its land is expropriated for a public utility project, compensation must be prior, and the administrative route remains open to court challenge on price (Constitución art. 58). Beyond domestic law, it can rely on the investment chapter of the Colombia Canada free trade agreement in force since August 2011 and on ICSID arbitration.
  • An investor from Argentina has the same constitutional and exchange guarantees, but no Colombia Argentina investment treaty appears on the Ministry of Commerce list, so treaty protection would need an investment structured through a treaty partner; see the Argentina guide for the Argentine side.

Step by step

  1. 1. Register every contribution with Banco de la República; the exchange guarantee only covers registered investment (Decreto 1068 art. 2.17.2.2.3.1).
  2. 2. Appoint the attorney in fact in Colombia required for foreign investors (art. 2.17.2.2.2.3).
  3. 3. Check whether your home country, or an intermediate holding jurisdiction, has an investment agreement in force on the MinCIT list, and its coverage dates.
  4. 4. Put dispute clauses in project contracts: Colombian courts and arbitration apply by default unless international arbitration is agreed (art. 2.17.2.2.4.1).
  5. 5. Keep the investment within the law: unregistered, prohibited or unlawful investments lose exchange rights (art. 2.17.2.2.4.2).

Common traps

  • Assuming the exchange guarantee covers unregistered capital. Rights arise only after the investment is made and its registration filed (Decreto 1068 art. 2.17.2.2.3.1).
  • Reading national treatment as absolute. The Constitution lets the law restrict foreigners' civil rights for public order, and statutes cap foreign stakes in television and armed private security (Constitución art. 100).
  • Counting on a treaty that is only signed. The agreements with the United Arab Emirates, Turkey and the 2021 Spain agreement are listed as signed, not in force (MinCIT list).
  • Expecting a stability contract. Legal stability contracts closed to new applicants in 2012 (Ley 1607 de 2012 art. 166).
  • Waiving treaty protection by contract. Absent an international arbitration clause, investment regime disputes go to Colombian courts and arbitration (Decreto 1068 art. 2.17.2.2.4.1).
