Colombia has been an ICSID contracting state since 14 August 1997, and the ICSID list of contracting states dated 16 August 2026 still shows it with no denunciation recorded; a denunciation would take effect six months after notice and would not affect consent given before. The trade ministry lists investment protection in force under bilateral treaties (including Spain, Switzerland, Peru, China, India, the United Kingdom, Japan, France and, from 30 March 2026, Venezuela) and in free trade agreement chapters (including Mexico, Chile, Canada, the United States, EFTA, Israel, Korea, Costa Rica and the Pacific Alliance). The Agencia Nacional de Defensa Jurídica del Estado coordinates the State's defence and amicable settlement; ICSID awards are enforced in Colombia as final judgments.

The rule

1. Colombia signed the ICSID Convention on 18 May 1993, deposited ratification on 15 July 1997 and became a contracting state on 14 August 1997. Congress approved it by Ley 267 de 1996. The ICSID list as of 16 August 2026 shows Colombia as a contracting state with no denunciation note (unlike states such as Ecuador, whose 2009 denunciation is noted).Ley 267 de 1996 (Diario Oficial 42.704 of 30 January 1996); ICSID/3 list of contracting states, ICSID list, Colombia entry, 1996-01-29 official text · verified 2026-10-26
2. ICSID jurisdiction covers legal disputes arising directly out of an investment between a contracting state and a national of another contracting state that both consent to in writing. Once given, consent cannot be withdrawn unilaterally. Awards are binding with no appeal other than the Convention's remedies, and every contracting state must enforce their pecuniary obligations as a final judgment of its own courts.ICSID Convention (approved by Ley 267 de 1996), Art. 25, 53 and 54, 1996-01-29 official text · verified 2026-10-26
3. A contracting state may denounce the Convention by written notice; denunciation takes effect six months after the depositary receives it and does not affect rights and obligations arising from consent to ICSID jurisdiction given before the notice was received.ICSID Convention, Art. 71 and 72, 1965-03-18 official text · verified 2026-10-26

Worked example

  • A US investor whose concession is cancelled may consider a claim under chapter 10 of the US trade promotion agreement, after any notice and waiting periods in that chapter.
  • If the tribunal awards damages, Colombia must comply; an ICSID award is enforceable in Colombia as a final judgment without review, while a non ICSID treaty award would go through recognition under Ley 1563.
  • The Agencia Nacional de Defensa Jurídica del Estado leads Colombia's side, including any amicable settlement talks.

Step by step

  1. Map your ownership chain to see which treaty nationality you can rely on, before a dispute arises.
  2. Read the specific treaty: notice of intent, cooling off periods, waivers of local remedies and time limits differ.
  3. Send notice to the State (the Agency coordinates the defence) and explore amicable settlement.
  4. File under ICSID or the treaty's alternative rules, and track any change in Colombia's ICSID status on the ICSID list.

Common traps

  • Treaty protection depends on the investor's nationality and the investment definition in each treaty; restructuring after a dispute is foreseeable may not qualify.
  • Signed treaties not yet in force (for example the 2021 Spain agreement, Singapore, Turkey, the UAE) give no protection yet.
  • A future ICSID denunciation would take effect six months after notice; consent already given survives under art. 72, but treaty specific consent rules matter.
  • No Colombia and Argentina investment agreement appears on the ministry's list, although both countries are ICSID contracting states.
