Last verified: 2026-10-30 · Status: Stable
Assignments of receivables, whether by sale, discount or security, fall under Ley 45-20 and must be registered in the SEGM to gain priority. Banks may do invoice discounting and financial leasing as listed activities. The article text leaves room for non bank factors funding themselves from their own resources, but funding from the public would need a licence.
USD figures use the Banco Central de la República Dominicana reference selling rate of RD$60.9007 per US dollar for 29 October 2026, rounded to the cent.

The rule
Worked example
- A supplier sells RD$5,000,000 (US$82,100.86) of invoices at a 3% discount, receiving RD$4,850,000 (US$79,637.84). The buyer pays a RD$1,000 (US$16.42) SEGM notice fee, so the priority cost is flat regardless of invoice volume. The discount rate is commercial, not statutory.
Step by step
- Search the assignor in the SEGM for a prior general charge on receivables.
- Sign the assignment and register it.
- Notify account debtors under Ley 45-20 art. 35.
- For consumer portfolios, notify users as art. 81 of the 2026 regulation requires.

- An unregistered factor can lose to a lender with a prior registered charge on receivables.
- Non bank factors funded from the public risk the art. 3 intermediation test of Ley 183-02.
- The tax treatment of leasing and factoring is not covered by these provisions; take it from the tax pages and advice.
