Last verified: 2026-10-26 · Status: Changing
Paying or accepting cash, in pesos or foreign currency, to buy or create real rights over real estate worth 8,025 UMA or more (MXN 941,412.75 in 2026) is prohibited, even if paid through a bank. Developers and brokers file notices for operations of 8,025 UMA or more, notaries for real estate deeds of 8,000 UMA or more, and landlords are covered when monthly rent exceeds 1,605 UMA, with notices from 3,210 UMA. Real estate AML thresholds with the 2026 UMA of MXN 117.31 (LFPIORPI arts. 17 and 32, as reformed DOF 16 July 2025).
Worked example
- A foreign buyer agrees to buy a condominium for MXN 2,400,000 (about USD 128,591). The price is above 8,025 UMA, so no part of it may be paid in cash (art. 32). The developer files a notice, and so does the notary because the value exceeds 8,000 UMA; both will ask for identification and beneficial owner information.
Step by step
- 1. Pay by wire transfer from an account in the buyer's name; keep the bank trail.
- 2. Expect identification and beneficial owner questions from developers, brokers and notaries.
- 3. Landlords with high rents: check whether rent exceeds 1,605 UMA a month and file notices from 3,210 UMA.
- 4. Report cash receipts over MXN 100,000 to the SAT by the 17th of the next month.
Common traps
- Paying any part of a large price in cash, even deposited at a bank: prohibited (art. 32).
- Using old thresholds: the July 2025 reform changed several items; amounts move each February with the UMA.
- Developers taking presale deposits: receipt of funds for a development is now a vulnerable activity (art. 17, V Bis).
