The rule

1. The Inversionista resident status lets a foreigner establish, develop or manage one or more lawful investments under Peruvian law. The investment amount and other conditions are set by the regulation; the stay is 365 days, renewable, with multiple entries.Decreto Legislativo Nº 1350, Decreto Legislativo de Migraciones, as amended by Decreto Legislativo Nº 1582, Art. 29.2 f, 2023-11-14 official text · verified 2026-10-28
2. The investment must be at least S/ 500,000, an amount Migraciones can change by Resolución de Superintendencia. The investor may only act as manager or director of their company, complying with labor and tax rules, and this post is outside the foreign staff quotas of Decreto Legislativo Nº 689. The investment can never be supported by a transfer of shares.

Example: A new S.A.C. with S/ 500,000 of paid in capital wired from abroad qualifies; buying S/ 500,000 of shares from an existing partner does not. / The threshold is about US$144,843.57 at S/ 3.452 per US$; the S/ amount is what counts, so exchange rate moves change the dollar cost.Reglamento del Decreto Legislativo Nº 1350, approved by Decreto Supremo Nº 007-2017-IN, Art. 86.1 a) and b), 86.2 and 86.3, 2017-03-27 official text · verified 2026-10-28
3. Application from abroad: the file needs the passport, five year record certificates, and proof that the investment of at least the regulatory amount was made by an international transfer in a single disbursement through a bank or financial entity supervised by the Superintendencia de Banca, Seguros y AFP. For a new company, add the incorporation deed dated no more than three months earlier; for a capital increase in an existing company, add the capital increase deed signed no more than three months earlier, proof of filing and payment of the company's last annual income tax return showing it operated in the previous year, and the number and municipality of its operating license. The investor must comply with Decreto Legislativo Nº 689. Migraciones decides within 30 business days, negative silence.
Cost to do it: Migraciones fee S/ 57.60 (about US$16.69); carné de extranjería S/ 24.00 (about US$6.95) after entry.Texto Único de Procedimientos Administrativos (TUPA) de la Superintendencia Nacional de Migraciones, as modified by Resolución de Superintendencia Nº 000150-2025-MIGRACIONES, Procedure PA35009B76 (Solicitud de Calidad Migratoria Inversionista Residente), 2025-12-12 official text · verified 2026-10-28
4. Change of status inside Peru: the same investment proof (S/ 500,000 by single international transfer), plus the INTERPOL Lima exchange record issued within six months; the procedure is personal and cannot be done through a representative, and the company and any capital increase must be registered with SUNARP. The result is the carné de extranjería.
Cost to do it: S/ 161.40 (about US$46.76).Texto Único de Procedimientos Administrativos (TUPA) de la Superintendencia Nacional de Migraciones, as modified by Resolución de Superintendencia Nº 000150-2025-MIGRACIONES, Procedure PA3500229B (Cambio de Calidad Migratoria a Inversionista Residente), 2025-12-12 official text · verified 2026-10-28
5. Annual extension: filed in person from inside Peru with a sworn statement of no record, proof of filing and payment of the company's last annual income tax return showing it operated in the previous year, and the capital increase deed where the investment was made in an existing company. The company must be registered with SUNARP and the investor must be current with the duties of DL 1350 art. 10 or have paid any fine. Migraciones decides within 5 business days.
Cost to do it: S/ 20.20 (about US$5.85) per year.Texto Único de Procedimientos Administrativos (TUPA) de la Superintendencia Nacional de Migraciones, as modified by Resolución de Superintendencia Nº 000150-2025-MIGRACIONES, Procedure PA35004A5A (Prórroga de la Calidad Migratoria Inversionista Residente), 2025-12-12 official text · verified 2026-10-28

Worked example

  • A Spanish entrepreneur incorporates an S.A.C. in Lima to run a logistics business and wires S/ 500,000 (about US$144,843.57) as capital from a Madrid bank account to the company's account at a Peruvian bank in one transfer.
  • Within three months of the incorporation deed, the entrepreneur applies from Spain for Inversionista (S/ 57.60) with the bank proof of the single wire, the deed and apostilled record certificates.
  • Once in Peru, the entrepreneur works as general manager on the company payroll, which the status allows, and the post does not count against the 20 percent foreign headcount cap.
  • Each year the extension (S/ 20.20) needs the company's filed annual return showing activity, so a dormant company puts the status at risk.
  • After three years, with ten Peruvian employees, taxes current and gross income of at least 10 UIT, the entrepreneur applies for permanent residence (S/ 161.40).

Step by step

  1. Incorporate the company (see entities/sociedad-anonima-cerrada) or approve a capital increase, and register it with SUNARP.
  2. Wire the full S/ 500,000 (or its equivalent) from abroad in one transfer to a bank supervised by the SBS; keep the SWIFT and bank certificates. See fx/capital-contributions-and-repatriation for the FX side.
  3. File the Inversionista application from abroad within three months of the deed, or the change of status in person if already in Peru.
  4. Obtain the carné de extranjería after entry; put the annual extension date in the calendar.
  5. Build the permanent residence file from day one: payroll with Peruvian staff, current tax filings, EsSalud contributions.

Common traps

  • Split wires or cash deposits leave the file without proof: the TUPA requires a single international transfer through an SBS supervised entity.
  • Share purchases do not count (DS 007-2017-IN art. 86.2), so buying into an existing company must be structured as a capital increase.
  • The deed must be no older than three months when filing, so do not incorporate long before you are ready to apply.
  • The status lets the investor work only as manager or director of their own company; consulting for other clients needs another status.
  • For a capital increase in an existing company the file needs that company's last annual tax return and operating license, so a newly formed shell cannot use the capital increase route.
