Consumer claims in Colombia: the Superintendencia de Industria y Comercio as judge, the prior claim rule and one year limits

Last verified: 2026-10-26 · Status: Stable

Consumer protection suits under the Estatuto del Consumidor (Ley 1480 de 2011) can be brought before the Superintendencia de Industria y Comercio acting as a judge nationwide or before ordinary judges, in a summary procedure, without a lawyer. The consumer must first complain directly to the producer or supplier, who has 15 business days to answer; the suit must be filed within one year (after the warranty ends, after the contract ends, or after learning the facts). Financial consumers can go to the Superintendencia Financiera, and since Ley 2444 de 2025 tourism claims may bring in airlines or travel agencies as third parties.

3. Consumer protection cases follow the summary verbal procedure. Worked example

  • A consumer buys a laptop with a one year warranty ending 30 June 2026 and it fails in May 2026. They complain to the retailer, which must answer within 15 business days.
  • If the answer is negative, the consumer may sue before the Superintendencia de Industria y Comercio until 30 June 2027 without a lawyer, attaching the complaint and the answer.

Step by step

  1. For businesses: set up a complaint channel that records phone and verbal claims and answers within 15 business days with evidence.
  2. Keep warranty and sales records for at least the warranty period plus one year.
  3. Respond to Superintendencia proceedings within the summary procedure terms; pre trial expert reports can be prepared by registered experts.

Common traps

  • A verbal complaint counts: if the supplier fails to issue a receipt, the consumer may state the complaint under oath.
  • The Superintendencia can decide several similar cases in one hearing, which can multiply exposure.
  • Administrative fines under art. 61 are set in minimum wages in the statute; check how they convert under Ley 2294 de 2023 art. 313 (UVB) before estimating exposure.
