Tutela, popular and group actions in Colombia: fast constitutional claims and collective litigation businesses face
Last verified: 2026-10-26 · Status: Stable
The tutela lets any person ask any judge to protect fundamental rights against public authorities and, in listed cases, private parties; the judge must rule within 10 days and orders are complied with within at most 48 hours. Popular actions protect collective rights (environment, consumers, public space) and can be brought while the threat lasts; group actions let at least 20 people with a common cause claim damages within two years. For companies these actions are a real exposure: tutelas reach private entities where the claimant is subordinate or defenceless, and group judgments order a collective indemnity paid into a public fund.

The rule
Worked example
- A health insurer denies a treatment: the patient files a tutela on Monday; the judge must rule within 10 days and may order delivery within 48 hours. An appeal does not suspend compliance.
- A pollution incident affects a neighbourhood: residents may bring a popular action to stop it, and at least 20 people with similar losses may bring a group action within two years for damages.
Step by step
- Designate a team that can respond to tutelas within the short report deadlines the judge sets.
- Comply with any order within the term even if you challenge it within three days.
- Assess collective exposure (environment, consumers, public services) and keep evidence of compliance.
Common traps
- Ignoring a tutela order is contempt (desacato), punishable by arrest of up to six months and a fine of up to 20 minimum wages (Decreto 2591 de 1991 art. 52); a challenge does not suspend the order.
- Popular actions have no fixed deadline while the threat lasts.
- Group action damages are paid as a lump sum into a public fund, so later claimants can still collect.
