Foreign workers in the Dominican Republic: the 80% rule, contract registration and migration fines

Last verified: 2026-10-30 · Status: Changing

At least 80% of a company's workers and 80% of its pay must go to Dominicans, with exceptions for management, technical staff and some spouses. A foreign worker's written contract is registered with the Ministry and needs a work category under migration law. Hiring someone not authorized to work costs 5 to 30 minimum salaries.

Art. 135 and art. 137 headcount tests

Worked example

  • A startup with five staff can have two foreigners on the headcount table, and a foreign chief executive who only manages is outside the count under art. 138.

Step by step

  1. Run the headcount and payroll tests on the roster.
  2. Confirm exempt roles with evidence.
  3. Apply for the Ministry certificates through its web system.
  4. Obtain the visa in the right migration category.
  5. Sign the contract in writing and register it.
  6. Request the social security number in SUIR.

Common traps

  • Test exemptions are narrow: a technical worker needs a finding that no Dominicans are available.
  • A tourist card gives no right to work, as Resolución 25/2001 notes.
  • An expired migration status does not end the employer's pay duties.
  • Very serious labor fines also apply to breaches of foreign worker rules under art. 720.
  • Visa categories and fees are in the immigration section.
