Workplace safety and work accident insurance in Uruguay: the BSE monopoly cover, employer liability and criminal risk

Last verified: 2026-10-27 · Status: Stable

Every employer must insure all employees against work accidents and occupational illness with the State Insurance Bank (BSE); with the policy in place, claims go against the BSE and the employer is shielded unless it acted with intent or gross negligence in breaching safety rules. The BSE pays medical care and a daily benefit of two thirds of pay during temporary incapacity; uninsured employers must fund the full cost of benefits, and victims must be readmitted and protected from dismissal for 180 days. Employers who fail to take legally required safety measures and put workers in serious and concrete danger face three to 24 months of prison, and accidents must be logged within 24 hours.

The rule

1. Employers in establishments where workers face danger must adopt the safety measures needed to prevent work accidents, under regulations issued by the Executive for each industry (currently including Decretos 406/988, 307/009, 394/018 and 246/024 according to IMPO).Ley Nº 5.032 (Work accident prevention), Law as summarized on IMPO, 1914-07-21 official text · verified 2026-10-27
2. Insurance against work accidents and occupational illness is mandatory. Every employer, public or private, is civilly liable for accidents and occupational illnesses of its employees caused by or on the occasion of work. An employee is anyone doing habitual or occasional paid work in subordination. The law is public order: any agreement releasing the employer is void.
Cost to do it: A premium charged by the Banco de Seguros del Estado according to the activity and payroll; Ley 16.074 does not fix the rate.Ley Nº 16.074 (Work accidents and occupational illness), Art. 1, 2, 3 and 13, 1989-10-10 official text · verified 2026-10-27
3. Once the employer proves it holds the mandatory insurance, the victim's action must be brought directly against the BSE and the employer is released from civil liability, unless the employer acted with intent or gross negligence in breaching safety and prevention rules; in that case the employer must fully repair the damage not covered by the insurance and the BSE excludes the claim and recovers its costs.Ley Nº 16.074 as reworded by Ley Nº 19.196, Art. 7, 2014-03-25 official text · verified 2026-10-27
4. The BSE gives medical care and pays benefits to all covered workers whether or not the employer insured them; for uninsured employers benefits are computed on a national minimum wage and the BSE demands from the employer the capital needed for pensions and reimbursement of costs. Commuting accidents are excluded unless the worker was on an employer ordered task, the employer provided transport, or access to the workplace carries special risk.Ley Nº 16.074, Art. 8 and 14, 1989-10-10 official text · verified 2026-10-27
5. During temporary incapacity the victim receives a daily benefit of two thirds of the daily or monthly wage at the time of the accident, including holidays; for irregular or piece work the base is the six month pay divided by 150. Time off for accidents or occupational illness cannot be counted as annual leave.
Example: A worker earning UYU 75,000 a month receives a temporary benefit based on two thirds of pay, UYU 50,000 a month equivalent, from the BSE. / UYU 50,000 is about US$1,243.Ley Nº 16.074, Art. 19, 20 and 70, 1989-10-10 official text · verified 2026-10-27
6. A victim must be readmitted on request after recovery (or to a compatible job if partially disabled), must report within 15 days of discharge, and cannot be dismissed for 180 days after returning save notorious misconduct or serious supervening cause; failing readmission within 15 days the employer owes triple severance.Ley Nº 16.074, Art. 69, 1989-10-10 official text · verified 2026-10-27
7. An employer, or whoever effectively exercises management on its behalf, who fails to adopt the safety measures required by law and regulations, so as to put the life, health or physical integrity of a worker in serious and concrete danger, is punished with three to 24 months of prison.Ley Nº 19.196 (Corporate criminal liability for safety), Art. 1, 2014-03-25 official text · verified 2026-10-27
8. Employers must record work accidents in the Labor Record Book within 24 hours, with date, names, a short description and preventive measures, and the BSE policy number must appear on the book's first folio.Decreto Nº 278/017, Art. 15 and 16, 2017-10-02 official text · verified 2026-10-27

Worked example

  • A warehouse worker on UYU 60,000 a month (about US$1,492) breaks a wrist after a fall. The employer logs it within 24 hours, the BSE treats the worker and pays a daily benefit based on two thirds of pay; on discharge the worker reports back within 15 days and must be readmitted and kept for at least 180 days.
  • If the fall happened because the employer ignored a regulatory guard rail requirement after inspection warnings, the BSE can exclude the claim and recover costs, the employer must cover the full damage, and the manager in charge risks prosecution under Ley 19.196.

Step by step

  1. 1. Take out the BSE work accident policy before the first worker starts and note the policy number in the Labor Record Book.
  2. 2. Identify the safety regulations for the activity and implement the required measures.
  3. 3. Log every accident within 24 hours and report it to the BSE.
  4. 4. Readmit recovered workers and respect the 180 day protection.
  5. 5. Review safety compliance at management level: criminal exposure is personal.

Common traps

  • Without the BSE policy the employer pays the full cost of benefits and loses the civil liability shield.
  • Gross negligence in safety rules removes the shield even with insurance.
  • Commuting accidents become covered if the employer provides transport.
  • Unhealthy activity classification adds six hour days and semiannual medical checks (Ley 11.577).
