Zoning, subdivision and building permits in Uruguay: land categories, cessions, value capture and planning fines

Last verified: 2026-10-27 · Status: Stable

Each Uruguayan department categorises its land as rural, urban or suburban through planning instruments, and rural land cannot be urbanised or subdivided for housing (Ley Nº 18.308 art. 30 and 31). New developments cede at least 8 to 10 percent of the area and build their own infrastructure, and departments capture 5 percent of buildable area in transformed land and 15 percent of extra buildability in urban renewal (art. 38 and 46). Works without permit are null and fined from 50 to 50,000 UR, with demolition at the owner's cost (art. 68 and 71).

The rule

1. Departmental governments have exclusive power to categorise land in their territory through territorial planning instruments, as rural, urban or suburban, with sub categories; future uses are planned with the attribute of potentially transformable land. Urban land is split into consolidated (with water, drainage, paved roads, sewage, power and lighting) and non consolidated.
Cost to do it: No fee; the cost is the land category's limits.
Example: The same plot can be worth very different amounts depending on whether the department categorises it as urban or rural. / Check the departmental instrument before paying for development potential.Ley Nº 18.308 (territorial planning and sustainable development) art. 30 (wording by Ley Nº 20.212 art. 381 and Ley Nº 20.446 art. 421) and art. 32, Art. 30 and art. 32, 2025-12-16 official text · verified 2026-10-27 · changed: Ley Nº 20.446 art. 421 (in force 1 January 2026) reworded the third paragraph of Ley Nº 18.308 art. 30 on planning future uses through the potentially transformable attribute.
2. Instruments for urban, suburban or transformable land must reserve land for open space, facilities and land banks of at least 10 percent of the area developed (reducible to 8 percent by the department), ceded free to the department, and new subdivisions must build at their own cost the roads and connections and the required infrastructure before final authorization.
Cost to do it: Cession of 8 to 10% of the area plus infrastructure at the developer's cost.
Example: A 10 hectare residential subdivision cedes at least 1 hectare (0.8 if the department reduces the standard). / Factor the cession into land price for any subdivision.Ley Nº 18.308, Art. 38, 2008-06-18 official text · verified 2026-10-27
3. Departments are entitled to share in the increase in value created by planning: at least 5 percent of the total buildable area in land to be transformed, and 15 percent of the extra buildable area in urban renewal areas, paid by ceding land free of charges, or by agreement in money to a territorial management fund or by swap. Instruments may allow building above the basic coefficient against a payment of up to 50 percent of the resulting extra value, and may impose duties to subdivide, build or use idle land within set deadlines.
Cost to do it: 5% or 15% value capture; up to 50% of extra value for higher density.
Example: A developer granted extra floors may pay the department up to half the value of the extra buildable area. / Negotiate value capture early with the Intendencia.Ley Nº 18.308 art. 46 (first paragraph by Ley Nº 20.212 art. 386), art. 60 and art. 61, Art. 46, art. 60 and art. 61, 2023-11-06 official text · verified 2026-10-27
4. Departments may have a preference right to buy property sold between private parties in areas set by planning instruments (without prejudice to the INC). They police works, subdivisions and land operations, may prohibit, stop and demolish works breaching instruments at the owner's cost, and must prevent unauthorised housing subdivisions.
Cost to do it: Demolition at the owner's cost.
Example: A plot in a designated area may first have to be offered to the department. / Check for preference areas in the instrument.Ley Nº 18.308, Art. 66, art. 68 and art. 69, 2008-06-18 official text · verified 2026-10-27
5. Any work, change to a plot or physical alteration of the land made without permit or in breach of instruments is null and is fined from 50 UR to 50,000 UR by seriousness, and the authority may restore the previous situation at the offender's cost. Appeals against demolition orders suspend them unless the authority lifts the suspension by reasoned resolution.
Cost to do it: Fines of UYU 97,038 to UYU 97,038,500.
Example: 50 UR is about UYU 97,038; 50,000 UR about UYU 97,038,500. / About US$2,413 to US$2,413,293.Ley Nº 18.308, Art. 71, 2008-06-18 official text · verified 2026-10-27

Land categories (Ley Nº 18.308 art. 30 to 32)

Worked example

  • A developer buying 20 hectares of suburban land for a gated community must check the category, cede at least 8 to 10 percent for public uses, build the roads and connections, and agree the department's value share before final authorization.

Step by step

  1. Request the departmental planning information for the padrón.
  2. Confirm category and buildability before signing.
  3. Agree cessions, value capture and infrastructure with the Intendencia.
  4. Obtain permits before any works; fines and demolition follow otherwise.

Common traps

  • Rural land cannot be urbanised without recategorisation.
  • Value capture can absorb 5 to 15 percent of buildable area.
  • Works without permit are null and fined up to 50,000 UR.
